Politely Terms of Service


Effective Date: January 1, 2026


Welcome to Politely! Politely provides a private, AI‑supported way for people to share feedback with businesses and for businesses to listen and respond. By accessing or using our services — including our app, website, and any related tools (the “Service”) — you agree to these Terms of Service (“Terms”). Please read them carefully.


1. Using Politely

Politely is designed to help people share private, constructive feedback with businesses, places, and products, and to help businesses learn from that feedback and build better relationships.

You may use the Service only if:

  • You are at least 13 years old; and

  • You have the legal capacity to enter into a binding agreement in your jurisdiction.

When you use Politely, you agree to:

  • Use the Service only for lawful and respectful purposes.

  • Not misuse, interfere with, or disrupt the Service (including by spamming, scraping, reverse engineering where prohibited, or attempting unauthorized access).

  • Only submit honest feedback based on your real experiences and not knowingly submit false, misleading, or defamatory information.

  • Not use Politely to harass, threaten, discriminate, or otherwise harm others.

We may update, pause, or discontinue parts of the Service from time to time as we improve Politely.

2. Accounts and Access

Certain features of Politely require an account. When you create an account, you agree to:

  • Provide accurate information and keep it up to date.

  • Maintain the security of your login credentials and not share them with others.

  • Be responsible for all activity that occurs under your account.

You may not impersonate another person or business, misrepresent your identity or affiliation, or create an account for someone else without their permission. Politely may offer both personal user accounts and business accounts; additional terms may apply to business subscriptions and features.

3. Your Feedback and Content

Ownership

You retain ownership of the content you submit through Politely, including feedback, photos, videos, and other materials (collectively, “User Content”).


License to Politely

To operate and improve the Service, you grant Politely a worldwide, non‑exclusive, royalty‑free, transferable, and sublicensable license to host, use, reproduce, modify, adapt, translate, create derivative works from, store, and display your User Content as reasonably necessary to:

  • Deliver your feedback privately to the businesses you select.

  • Provide AI‑powered moderation, rewriting, and analytics.

  • Show your own feedback history and related insights within your account.

  • Operate, maintain, secure, and improve the Service.

We may use aggregated or de‑identified versions of User Content to generate analytics and insights for businesses and to improve Politely, but we do not sell your personal data.

Sharing with Businesses

When you submit feedback to a business, you understand that:

  • The business will receive your feedback content and your chosen identity (for example, your screen name and avatar) rather than your real name or contact details by default, unless you choose to include such details in your feedback.

  • Businesses may review, act on, and respond to that feedback through Politely or their own tools.

Politely is not responsible for how businesses choose to act on feedback they receive (for example, policy changes, offers, or follow‑up communications).

Acceptable Content

You agree not to submit User Content that:

  • Is false, misleading, or defamatory.

  • Is threatening, abusive, harassing, or hateful.

  • Is obscene or sexually explicit.

  • Promotes discrimination, bigotry, or violence against individuals or groups.

  • Contains personal or confidential information about others without their consent.

  • Infringes or violates someone else’s intellectual property, privacy, or other rights.

Politely may use AI and other moderation tools to help identify and reduce harmful or unhelpful content. We reserve the right, but are not obligated, to review, remove, or restrict access to User Content or accounts that we believe violate these Terms or pose a risk to users, businesses, or the Service.


4. AI and Automated Features

Politely uses AI and automated systems to:

  • Help rewrite feedback for tone, clarity, and structure.

  • Detect potentially abusive, unsafe, or policy‑violating content.

  • Provide businesses with aggregated insights and trends.

AI‑generated suggestions and responses are provided as assistance only. You are responsible for reviewing and approving your feedback before sending it, and businesses are responsible for reviewing and approving any AI‑assisted responses they send.

Politely does not guarantee that AI outputs will be free from errors or bias and is not liable for decisions you or businesses make based on them.


5. Privacy

Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.

By using Politely, you agree that we can use your information in accordance with the Privacy Policy.


6. Business Use and Subscriptions

Politely may offer business features, including dashboards, analytics, and subscription plans that allow businesses to access and manage feedback.

If you use Politely on behalf of a business, you represent and warrant that:

  • You are authorized to bind that business to these Terms.

  • Your use of Politely complies with applicable laws and your internal policies.

Business subscription pricing, billing, and plan details (including any free trials) are provided within the Service or in separate terms. By starting a paid subscription, the business agrees to the applicable fees, billing cycles, and cancellation terms.

Politely is not responsible for any commitments or representations businesses make to their customers as a result of feedback they receive through the Service.


7. Termination and Suspension

You may stop using Politely and request account deletion at any time.

We may suspend or terminate your access to the Service, in whole or in part, without prior notice if:

  • You violate these Terms or our other policies.

  • We reasonably believe your use poses a risk to other users, businesses, Politely, or third parties.

  • We are required to do so by law or by a service provider.

Upon termination, your right to use the Service will stop immediately. Certain provisions of these Terms that by their nature should survive termination (such as ownership, licenses for already‑used content, disclaimers, and limitations of liability) will remain in effect.


8. Disclaimers

The Service is provided “as is” and “as available,” without any warranties of any kind, whether express or implied. To the fullest extent permitted by law, Politely and its affiliates disclaim all warranties, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non‑infringement.

  • Warranties that the Service will be uninterrupted, secure, or free of errors or harmful components.

  • Warranties regarding the accuracy, reliability, or completeness of any content, insights, or analytics provided through the Service.

You are solely responsible for your interactions with businesses and other users. Politely does not control and is not responsible for how businesses respond to feedback or for any actions they take based on feedback or analytics.


9. Limitation of Liability

To the fullest extent permitted by law, Politely and its affiliates, officers, employees, and agents will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.

  • Loss of profits, revenues, data, goodwill, or other intangible losses.

This applies whether or not we have been informed of the possibility of such damages and whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.

To the extent we are found liable despite the foregoing, our total aggregate liability arising out of or relating to the Service or these Terms will be limited to the greater of (a) the amount you paid to Politely for the Service in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you.


10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, our practices, or the law.

If we make material changes, we will provide notice through the app, website, email, or other reasonable means. The updated Terms will be effective as of the date indicated. Your continued use of Politely after the updated Terms are effective constitutes your acceptance of them.

If you do not agree to the updated Terms, you must stop using the Service.


11. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Service are governed by the laws of the State of California, without regard to its conflict of laws principles, unless the laws of your state or country require otherwise.

Any claims or disputes will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Politely consent to the personal jurisdiction of those courts, except where applicable law provides you with a right to a different forum.
